1. Acceptance of Terms

By accessing the Fuzeev Ski Tutorials website or purchasing any digital product (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Service or purchase our products. These Terms form a binding agreement between you and Fuzeev Ski Tutorials (“Company,” “we,” “us”).

2. Definitions

• “Content” means our digital instructional materials: video lessons, written materials, images, and any downloadable or streaming assets.
• “Defective” means the Content has a material fault (e.g., corrupted file, non-functional stream) that prevents normal use.
• “Inaccessible” means you cannot reasonably access the purchased Content due to a technical fault on our side (e.g., system outage) and not due to your device, connection, settings, or regional/network restrictions outside our control.
• “Does not match its description” means the purchased Content materially differs from the key features and scope described on the product page at the time of purchase.
• “Order email” means the email address you used to complete the purchase.

3. Description of the Service

We provide digital alpine skiing tutorials (video + text) via our website for a one-time purchase (not a subscription). Access is granted under a limited, revocable license for personal, non-commercial learning. We strive to help you learn effectively, but we do not guarantee any specific outcome or skill acquisition.

No lifetime guarantee: Access is provided while the Service is available; we do not guarantee lifetime or perpetual access, and availability may change for technical, legal, or business reasons.

4. Pricing, Payment & Taxes

Price: The current price for the product is USD $99 (one-time).

Payment: You authorize us or our payment processor to charge your selected payment method for the full amount at checkout.

Taxes: Applicable sales/VAT/GST/HST or similar taxes may be added based on your billing location. You are responsible for any taxes not collected at checkout.

5. Refund Policy (Digital Products)

Our voluntary consumer-friendly policy (worldwide): You may request a refund within 14 days of purchase if the digital product is defective, inaccessible, or does not match its description.

How to request a refund

1. Email us at fuzeevski@gmail.com from your order email (or provide proof of purchase if using a different address).
2. Include your order number, device/OS/browser used, and a brief description (screenshots if possible) of the defect, inaccessibility, or mismatch.
3. We will acknowledge receipt and typically respond within 4 business days. If eligible, refunds are processed to the original payment method.

EU/EEA/UK statutory notice: If you are a consumer in the EU/EEA/UK, you may have a 14-day statutory right of withdrawal for distance purchases. By choosing immediate access to digital content, you expressly consent to delivery and acknowledge that the statutory right of withdrawal may be lost once access begins, as permitted by law. If you have not accessed the Content and are within the statutory period, you may request cancellation and refund.

Except as required by applicable law or under the policy above, all sales are final after the 14-day window.

6. User Account & Access

You may need an account to access purchased Content. Keep credentials confidential. Access is personal; do not share, resell, or publicly post Content. We may suspend or terminate accounts for violations.

7. License & Intellectual Property

All Content is owned by Fuzeev Ski Tutorials or its licensors and protected by IP laws. Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for personal, non-commercial learning. You may not copy, distribute, share, publish, or make the Content available to third parties. No ownership rights are transferred.

8. Appropriate Use & Safety Conduct

• Use tutorials safely and responsibly; avoid reckless practices.
• Use appropriate equipment and safety gear suitable for alpine skiing (e.g., helmet, properly fitted skis/boots).
• Comply with laws and resort rules; respect our IP and technical protections.
• Do not harm the Service or other users (e.g., hacking, malware, harassment).

9. No Guarantees & Warranties

9.1 No Guaranteed Results

We do not guarantee any specific results, proficiency, or performance outcomes. Individual results vary based on factors beyond our control.

9.2 Educational Purpose Only

Content is general information, not personalized coaching or medical advice. Assess suitability for your own skill level and circumstances.

9.3 “As-Is” Service

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, or uninterrupted/error-free operation). Where certain disclaimers are not permitted by law, they apply only to the maximum extent allowed.

10. Health & Safety — Assumption of Risk

1. Inherent risks: Alpine skiing and related training carry inherent dangers (falls, collisions, strains/sprains, fractures, concussions, hypothermia, serious injury, or death). Risks cannot be eliminated.
2. Voluntary participation: You voluntarily engage in any practice based on the tutorials and assume all associated risks.
3. No supervision: We provide digital content only and do not supervise your practice. You are solely responsible for safe conditions and execution.
4. Health status: Consult a physician before training if you have any medical conditions or concerns. Stop immediately if you experience pain, dizziness, or other warning signs.
5. No impairment: Do not practice under the influence of substances that impair judgment or motor skills.
6. Release (subject to law): To the fullest extent permitted by applicable law, you waive and release claims against us for injuries arising from your participation. This does not waive liability that cannot be waived by law (e.g., gross negligence or willful misconduct where non-waivable).

11. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of data, profits, or business), regardless of theory, even if advised of the possibility. If liability is found notwithstanding the foregoing, our aggregate liability shall not exceed the amount you paid for the digital product that gave rise to the claim. Some jurisdictions do not allow certain limitations; where prohibited, they apply only to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Fuzeev Ski Tutorials and its affiliates from claims, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Service, breach of these Terms, violations of law, or third-party claims caused by your actions. We may assume exclusive defense; you agree to cooperate.

13. Third-Party Platforms & Links

If you purchased via a third-party platform (app store/marketplace), that platform’s refund and access rules may apply. External links in our Content are for convenience and are not endorsements. We are not responsible for third-party content, availability, or practices. Your use is at your own risk.

14. Privacy Policy

Your use is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.

15. Age Requirement

The Service is not directed to children under 16 or the age of majority in your jurisdiction, whichever is higher. If under the age of majority, a parent/guardian must purchase and accept these Terms on your behalf. We may refuse or terminate service if age requirements are not met.

16. Governing Law & Consumer Rights

These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-law rules. You and we submit to the non-exclusive jurisdiction of the courts of Russia.

Nothing in these Terms deprives consumers of any mandatory protections under the law of their country or province of residence (for example, EU/EEA/UK consumer law or Canadian provincial consumer protection statutes).

17. Dispute Resolution

Before filing a claim, contact us at fuzeevski@gmail.com to attempt informal resolution. We will act in good faith and typically respond within 4 business days. If unresolved, either party may proceed in court as specified in Section 16, unless another lawful forum is mandated. Nothing limits your statutory rights to seek legal relief.

18. Changes to These Terms

We may modify these Terms. For material changes, we will provide at least 30 days’ notice (e.g., banner on the site or email) before changes take effect, unless a shorter period is required by law. Continued use after the effective date constitutes acceptance. See the “Last Updated” date at the top.

19. Force Majeure

We are not liable for delays or failures to perform due to events beyond our reasonable control, including acts of God, extreme weather, natural disasters, war, terrorism, civil unrest, labor disputes, failures of utilities or telecommunications, platform/provider outages, regulatory changes, or other similar events.

20. Severability

If any provision is held invalid or unenforceable, that provision will be severed and the remainder will continue in full force. Any invalid term will be interpreted to best accomplish the original intent to the extent permitted by law.

21. No Waiver

Our failure to enforce any right or provision is not a waiver of future enforcement. Waivers must be in writing.

22. Entire Agreement

These Terms, together with any purchase confirmation and our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede prior or contemporaneous understandings relating to the subject matter.
